Please read these Terms of Service ("Terms") carefully before purchasing or using any digital product sold by Abhishek Sharma - Software Consulting ("we", "us", or "our"). By completing a purchase, you agree to be bound by these Terms.

1. Who We Are

Abhishek Sharma - Software Consulting is a software consulting business registered in India under MSME/Udyam Registration No. UDYAM-RJ-17-0607247. We develop and sell digital software products as one-time licenses.

2. Our Digital Products

We sell self-hosted software systems as one-time perpetual licenses. Each product's specific features, inclusions, and support terms are described on its individual product page at the time of purchase. Upon purchase of any product, you receive:

Access to the full source code repository via GitHub
The right to deploy and operate the software on your own server infrastructure
Support as specified in your purchased license tier
All features as described on the product page at the time of purchase

Our digital products are not subscription services. We do not host software on your behalf unless explicitly agreed in writing.

3. License Grant

Subject to your payment and compliance with these Terms, we grant you a non-exclusive, non-transferable, perpetual license to:

Install and use the purchased software on your own server(s)
Modify the source code for your own operational use
Create backups of the software

Agency / Reseller License

If you purchase an Agency or Reseller license (where offered), you are additionally granted the right to:

Deploy the software for multiple end clients
Rebrand and white-label the software for client use
Charge your clients for deployment and setup services

Restrictions (All Licenses)

You may not:

Resell, sublicense, or redistribute the source code itself as a standalone product
Offer the software as a hosted SaaS service to third parties (unless on an Agency License)
Remove or alter copyright notices within the source code
Use our product names or branding in your own product without written permission

4. Pricing & Payment

All prices are listed in USD. Payment is processed securely by Stripe. By completing a purchase you authorise the one-time charge for the license tier selected. The price displayed on the product page at the time of your purchase is the price you pay. Prices are subject to change for future customers.

5. Delivery

After successful payment, we will deliver GitHub repository access to the email address associated with your purchase within 24 hours. If you do not receive access within this timeframe, contact us at [hello@mrabhishek.com].

6. Support

Each product and license tier includes a defined support period as specified on its product page. Support is provided via email and scheduled calls and covers:

Deployment assistance
Configuration questions
Bug resolution related to the software

Support does not include general web development, server administration unrelated to the product, or third-party service configuration beyond what is documented.

After your support period ends, the software continues to function normally. Extended support may be available for purchase separately.

7. Your Responsibilities

You are solely responsible for:

The server infrastructure on which you deploy the software
The security and backup of your deployed instance
Compliance with all applicable laws in your jurisdiction, including data protection, consumer protection, and financial regulations
All end-user data processed through your deployed instance
Maintaining your own accounts with any third-party services the software integrates with (e.g. Stripe, email providers)

Any legal compliance guidance we provide is offered as a courtesy and does not constitute legal advice. It does not transfer compliance responsibility to us.

8. Intellectual Property

We retain all intellectual property rights in the original source code of our digital products. The license granted under Section 3 does not transfer ownership of intellectual property to you. Modifications you make to the code are your own intellectual property.

9. Disclaimer of Warranties

Our digital products are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

The software will be error-free or uninterrupted
It will meet every specific requirement of your business
Third-party integrations will remain available or unchanged

10. Limitation of Liability

To the maximum extent permitted by applicable law, Abhishek Sharma - Software Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising from your use of our products.

Our total liability to you for any claim shall not exceed the amount you paid for your license.

11. Refund Policy

Please refer to our Refund Policy page for full details. In summary: all sales are final once repository access has been granted. Refunds are available only if access has not been delivered within 48 hours of purchase.

12. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Rajasthan, India.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. The Terms in effect at the time of your purchase govern your license.
